Daily Journal: What techniques do you use to break a logjam in mediation?

Roe: It's important to keep them talking, so I use what was called in law school the Socratic method, consisting of asking questions that go against the grain of the common distributive bargaining approach. I challenge the attorneys to provide cogent support for their positions on settlement. This "rethinking" often leads to settlement.
