FAIR Plan coverage limits are illegal, lawsuit claims

Attorney Dylan L. Schaffer says his lawsuit seeking FAIR's compliance with minimum coverage requirements asks the court to do what the Department of Insurance should have already done.

California's home insurer of last resort violated state law by providing inadequate coverage for fire damage, according to a lawsuit filed in Alameda County. A 2022 report from the California Department of Insurance, included in the complaint against the California FAIR Plan, appears to show state officials should have been aware the coverage levels were illegal.
