Alameda DA must decide whether to retry case after 1991 death sentence overturned

The death sentence was overturned following an investigation into allegations of historical prosecutorial misconduct in the Alameda County DA's office.

Alameda County District Attorney Pamela Price announced on Wednesday the overturning of a 1991 death sentence handed down against Curtis Lee Ervin, who was convicted for the 1986 killing of Carlene McDonald in El Sobrante, but did not rule out the possibility of retrying the case. It's the latest development in an ongoing review of at least 35 death sentence convictions in the county over the past four decades due to concerns of prosecutorial misconduct.
