WASHINGTON -- For the second time in three weeks, Senate Democrats moved to pierce Republican opposition to a confirmation vote for a 9th U.S. Circuit Court of Appeals candidate. Party leadership filed Thursday for a procedural vote for nominee Andrew D. Hurwitz, currently a justice on Arizona's Supreme Court. If Hurwitz attracts the support of at least 60 senators, that would "invoke cloture" and clear the way for his confirmation, which requires 51 votes. But the procedural vote, scheduled for Monday, may not be necessary. Democrats set up the same type of vote for Paul J. Watford, and Republican resistance collapsed hours before the vote, allowing the Senate to go straight to confirmation. The Senate approved Watford 61-34. Hurwitz is the last 9th Circuit nominee. One vacancy on the circuit remains, but it's for a seat that's been open for more than seven years due to a dispute between the senators from California and Idaho over which state controls it.
