In September, Forgey settled a case involving a woman with muscular dystrophy who was rear-ended by a truck. The woman had to have a cervical fusion in her neck as a result. Forgey said the looming question during mediation was whether the trauma of an accident could exacerbate the woman's muscular dystrophy. The case settled for $675,000.
Forgey says he is not naturally touchy-feely. "I can get touchy-feely if the case demands it," he said. And every once in a while, he said, he likes to play devil's advocate. He adds, "Sometimes the settlement value of a case and what it takes to settle a case are not always the same. It can be more and it can be less."
