Santa Clara University sophomore Talbot Clarke became severely brain damaged in 2011 when she was struck by a van near her school.

Clarke broke several ribs, and her head collided with the windshield of the vehicle, causing severe trauma, according to local reports. The injuries caused ongoing seizures and at least eight hospital visits since the incident occurred.

Brandi sued the state, accusing the government was negligent in its placement and operation of traffic light at the intersection where Clarke was struck.

He successfully convinced a jury that the light did not provide enough time to cross the street and there was no way to tell how much time a person had because there was no countdown timer.

The jury found the state 95 percent at fault and awarded Clarke $26.6 million in damages for her hospital care.
