Facts
The plaintiff and defendant met in November 1989 and began living together in early 1995. In October 1999, the
relationship deteriorated and the defendant requested that the plaintiff move out of the residence. The plaintiff
refused to move out and refused to pay rent. The plaintiff did not allow the defendant to enter the residence and
threatened to dispose of his personal property.
The plaintiff brought this case based on breach of contract, constructive trust, conversion and declaratory relief
theories of recovery.
The defendant filed a cross-complaint for ejectment, conversion and for injunctive relief. The cross-complaint
was granted as to the ejectment and injunctive relief claims and the plaintiff was ordered to leave the residence.
The plaintiff refused to vacate the residence.
Prior to trial, the court granted the defendantÆs request that the plaintiff post a bond for the fair rental value for
her occupancy of the defendantÆs residence. The plaintiff was unable to post a bond and was ejected from the
premises.
Settlement Discussions
The plaintiff demanded $1 million. The defendant offered $25,000.
Damages
The plaintiff claimed entitlement of half of the assets and income earned during the relationship and lifetime support.
