Facts
On Nov. 6, 1995, the plaintiff, a 55-year-old woman, filed a complaint with upper management alleging that her manager was sexually harassing her with unwanted touching and verbal abuse. The defendant manager was terminated 10 days later, after an investigation by the defendant corporation. Six weeks later the defendant corporation terminated the plaintiff's employment. The plaintiff broughtthis action against the defendants based on sexual harassment, retaliation and wrongful termination theories of recovery. The plaintiff obtained her "right to sue letter" from the Department of Fair Employment and Housing. She filed the lawsuit in the Superior Court of the County of Riverside. The defendants petitioned the court for removal into binding arbitration, pursuant to a written employment application agreement.
