Facts

On April 18, 1994, the plaintiff, a 53-year-old business manager, slipped and fell when his left foot went into a test hole dug by roofers, which was subsequently covered by indoor-outdoor-carpeting without first being filled in. The plaintiff brought this action against the defendants based on negligence and premises liability theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $85,000, reduced to $50,000. The defendants made a C.C.P. º998 offer of compromise for $15,000.
