Facts

The 16-year-old decedent was taken to the emergency room at defendant El Centro Regional Medical Center with severe chest pain, radiating to the jaw and arms. Defendant Andre Sanschagrin was the emergency room physician at the defendant hospital who saw and treated the decedent at approximately midnight. Dr. Sanschagrin diagnosed pleurisy and discharged the decedent with a prescription for pain medications and an antibiotic. He had read an EKG and a chest x-rays as normal. The decedent continued to have chest pain at the time of discharge. The diagnosis and discharge instructions were given to the decedent by a nurse only. After the discharge at 2 a.m., the chest x-ray was seen and read by a staff radiologist who saw an abnormality near the right side of the heart. At 8 a.m., the decedent suffered a cardiac arrest and could not be resuscitated. An autopsy determined that the cause of death was ruptured aorta, along with probable Marfan's syndrome. The plaintiffs, the decedent's parents, brought this action against the defendants based on negligence and medical malpractice theories of recovery.
