On Jan. 29, 1995, the plaintiff, a 73-year-old retired businessman, was traveling on Lincoln Blvd. at night. The plaintiff stopped for pedestrians crossing the street and his vehicle was rearended by the defendant driver who was driving the defendant bank's vehicle in the course and scope of his employment. Prior to the accident, the plaintiff had never been injured or involved in a car accident. The plaintiff brought this action against the driver and the bank based on negligence theories of recovery.
Settlement Discussions
Per the defendants, the plaintiff made a settlement demand for $300,000 until the date of the settlement conference. The defendants made no settlement offers for one year. At the settlement conference, the defendant offered $43,750.

The plaintiff claimed that he suffered unilateral left sided tinnitus (ringing in the ear) for which there is no known treatment or surgery.
Other Information
The settlement was reached approximately one year after the case was filed. A mediation was held on Jan. 23, 1997 before Judge Robert D. Fratianne, retired, of ARC resulting in the reported settlement.
