Facts
On April 23, 1996, the plaintiff mother, a 37-year-old woman, was driving a vehicle in which her 17-year-old plaintiff daughter was a passenger. The plaintiffs were traveling eastbound on the I-10 freeway in the No. 4 lane, when the defendant truck driver in the No. 3 lane, changed lanes. The defendant's vehicle collided with the right rear of the plaintiffs' vehicle, causing the plaintiffs' vehicle to loose control and veer into the No. 3 lane. When the plaintiffs' vehicle entered the No. 3 lane, the defendant's vehicle struck the plaintiffs' vehicle head-on and catapulted the plaintiffs' vehicle into the center divider. The plaintiffs brought this action against the defendant based on negligence theories of recovery.
Settlement Discussions
The plaintiffs made a settlement demand for $70,000. The defendant made an initial settlement offer of $42,000.
