On Dec. 27, 1995, the plaintiff, a 46-year-old legal secretary, was traveling northbound on the 405 freeway in the No. 5 lane just south of the 101 interchange. The defendant, traveling in the No. 4 northbound lane, rearended a vehicle in front of him, causing a chain reaction multiple-car collision. The defendant's vehicle spun out of control and into the No. 5 lane, causing the plaintiff's vehicle to broadside the defendant's vehicle. The plaintiff brought this action against the defendant based on negligence theories of recovery.
Settlement Discussions
The plaintiff made a C.C.P. º998 settlement demand for $100,000. The defendant made no settlement offer but suggested it would settled for $60,000.

Injuries
The plaintiff alleged that she sustained cervical, thoracic and lumbar strain and sprain injuries requiring physical therapy. The plaintiff's symptoms continued, and seven months after the accident, a lumbar MRI showed 4 to 6 mm herniated disc at L4-5, resulting in nerve root compression and the need for a future discectomy. The plaintiff underwent a single epidural injection for her continuing symptoms.
