Facts
On Feb. 22, 1996, the plaintiff, a 91-year-old retiree, was a passenger in a vehicle that was traveling on the 60 freeway. The defendant driver, in the course and scope of his employment with the defendant employer, broadsided the vehicle in which the plaintiff was a passenger. The plaintiff brought this action against the defendants based on negligence theories of recovery.
Settlement Discussions
The plaintiff made a C.C.P. º998 settlement demand for $250,000. The defendants made a C.C.P. º998 offer of compromise for $175,000 (new money)

Other Information
The settlement was reached approximately one year after the case was filed. An arbitration was held on Dec. 6, 1996 before Barry Drucker resulting in an award of $263,000. The defendants requested a trial de novo.
