On Dec. 19, 1993, plaintiff John Carso, a 34-year-old pizza maker/scuba driving instructor, was pulled over by the defendant California Highway Patrol. The plaintiff license plate, LA CORSO, did not match the vehicle he was driving. Officers C. Siegel and E. Hofer approached the car. The plaintiff claimed the officers had their guns pointed at him, used abusive language, and injured his left shoulder while placing him in handcuffs. The plaintiff brought this action against the defendants based on assault and battery, excessive force and neligence theories of recovery. The vehicle which the plaintiff was driving was not stolen.
