Facts

On March 21, 1995, the plaintiff driver, a 33-year-old pregnant woman, was driving her vehicle when it was struck by the defendant driver who was attempting a left-hand turn. The police report and an independent witness favored the plaintiff although there was some question as to the color of the light at the time the plaintiff driver entered the intersection. The plaintiffs brought this action against the defendant based on negligence theories of recovery.

Settlement Discussions

The plaintiffs made a C.C.P. º998 settlement demand for $50,000. The defendant made a C.C.P. º998 offer of compromise for $100,000.

Injuries

The plaintiffs alleged that she underwent a cervical discectomy and her child was born prematurely a month later.

Other Information

The settlement was reached approximately two years after the case was filed, during jury selection.
