Facts

Avocent Sports Technology Inc. was issued a patent entitled Accumulating Altimeter with Ascent/Descent Accumulation Thresholds on Oct. 22, 1991. The patent involved sports accessories. In 1994, Avocent had a meeting with Polar Electro Inc. members for the possibility of a partnership and expansion of the Vertech, Avocent's product, via incorporation of Polar's heart rate technology. Subsequently, Polar sold several products, which it openly advertised on its website. In May 2012, Avocent sued Polar, alleging it infringed Avocent's patent when selling its products.

Result

The court granted Polar's Motion for Summary Judgment.
