Facts
On June 12, 1994, the claimant, a 12-year-old student, was a patient at the respondent hospital being treated for viral encephalitis. An I.V. of Dilantin was started for seizure prevention. There was no documentation reflecting the condition of the I.V. site at the time the I.V. was started. Several hours later, when the minor claimant was transferred into the intensive care unit, it was finally discovered that the I.V. had infiltrated, causing a chemical burn on the defendant's right forearm. The claimant brought this action against the respondent based on medical malpractice and negligence theories of recovery.
