Facts

On Jan. 8, 1995, the plaintiff, a 47-year-old longshore worker, was struck by a railroad car which crushed the plaintiff's right leg between the wheel of the rail car and the track while in the course and scope of her employment. The plaintiff brought this action against the defendants based on negligence and premises liability theories of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $3.5 million. The defendants made a C.C.P. º998 offer of compromise for $1.2 million.

Injuries

The plaintiff suffered near amputation of her right leg, and required psychiatric treatment.

Other Information

The settlement was reached approximately 11 months after the case was filed. SETTLEMENT CONFERENCE: A settlement conference was held on Nov. 15, 1996 before Judge Barrera resulting in the reported settlement.
