On July 18, 1996, plaintiff, Julio Gonzalez, a 30-year-old real estate mortgage broker, consumed a portion of cooked vegetables prepared at the defendant restaurant, The Good Earth. The plaintiff claimed that the vegetables contained live worms which caused him to suffer injuries. The plaintiff brought this action action against the defendant based on negligence and breach of implied warranty of fitness theories of recovery.
