Facts

On April 27, 1993, defendant Jose Sanchez needed a new roof on his Pacoima, Calif. house. His brother-in-law, Marcello Rodriguez, a union roofer, arranged for several people to help tear off the old roof and for Rosario Mejia, another union roofer to nail the new shingles on the roof. Plaintiff Apolonio Moreno, a 53-year-old union roofer, was allegedly asked by defendant Sanchez to help with the roof. While working on the roof, Moreno allegedly tripped and fell off the roof, approximately nine feet. The plaintiff brought this action against the defendant homeowners based on negligence theories of recovery.
