Facts
On Aug. 30, 1990, plaintiff Jennifer Larossa retained defendant Lenard Sampson, Esq., to handle a personal injury action which was filed in Ventura Municipal Court, but dismissed for failure to appear at a status conference. The plaintiff sued Sampson, who defaulted, and his non-attorney employee, defendant Leonard Carter, who signed the plaintiff up as a client. The plaintiff claimed that defendants Sampson and Carter conspired to pass Carter off as a lawyer and that both parties were liable for malpractice of the underlying action. Defendant Carter claimed that his conduct was proper and that he had nothing to do with the underlying action.
