Facts

On July 11, 1992, plaintiff Jan Watarz, a 38-year-old salesman, slipped and fell at defendant Valley Palms Apartments where he resided. The plaintiff claimed that he slipped on a slippery surface of which the defendant had notice. The plaintiff brought this action against the defendant based on premises liability and negligence theories of recovery.
