Facts

On Dec. 13, 1994, plaintiff Jae Mun Yoo, a 52-year-old tailor, visited his son's workplace to see his wife. Plaintiff Jae Mun Yoo and defendant Chan Yoo, the plaintiff's son, lived together and, until shortly before this incident, the father worked for the son at the son's sewing factory. The plaintiff heard that his wife was looking for a pattern to make pockets for blue jeans, and the plaintiff voluntarily used a ladder to climb into the loft area. The plaintiff climbed up to the top of the ladder and fell when the ladder slipped out from under him. The plaintiff father brought this action against the defendant son based on a negligence theory of recovery.

Settlement Discussions

The plaintiff made a C.C.P. º998 settlement demand for $______________. The defendant made a C.C.P. º998 offer of compromise for $________________ .

Specials in Evidence

$91,486.98 $15,000 - $18,000 (potential)

Injuries

The plaintiff alleged he sustained a fractured heel requiring surgery.

Other Information

The verdict was reached approximately one year and six months after the case was filed. Per the plaintiff, the plaintiff encouraged binding arbitration and settlement resolution up until trial, indicating a willingness to settle for the special damages plus a reasonable general damage offer. However, the defendant refused to propose any binding arbitration offer or settlement offer whatsoever, as they isisted this was a workers' compensation matter, and thus there was not third-party exposure.
