Facts

Beachbody LLC created the P90X Extreme Home Fitness product and other fitness programs, and investigated Wayne Batchelor because he was advertising and selling several pirated copies of P90X DVDs. Beachbody filed an action against Batchelor for copyright and trademark infringement.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff alleged that defendant's counterfeiting activities infringed on plaintiff's trademarks and copyrights, and that defendant engaged in such activities intentionally.

Result

The court awarded plaintiff $2.15 million, enjoined defendant from counterfeiting plaintiff's products, and ordered defendant to hand over any remaining products for obliteration.
