Facts

In Feb. 2009, Glen Beaty, a homeless man, was sleeping under a tree when officers Jeffrey Gross and Scott Payn approached him to check on his welfare. The officers ended up arresting Beaty, and during the arrest, one of the officers struck Beaty with his fist while the other tried to restrain him. A witness captured the incident on video.

Beaty filed suit against the City of Fresno, police chief Jerry Dyer, Gross, and Payn.

Contentions

DEFENDANTS' CONTENTIONS:
The officers alleged that Beaty was combative and intoxicated, at one point ripping off an officer's badge from his uniform and trying to stab him with a pen from the officer's pocket.

Result

The parties reached a settlement for $75,000.
