Case number: 3:2008-cv-00986 Bench Decision –  Partial Summary Judgment

Facts

Advanced Micro Devices Inc. (AMD) and ATI Technologies, ULC (ATI) sued Samsung Electronics Co. (Samsung) alleging patent infringement. The complaint alleged that Samsung incorporated inventions protected by seven AMD and/or ATI patents. AMD/ATI patents generally relate to semiconductors, semiconductor memory, and related products. These included patents for dynamic random access memory (DRAM), static random memory (SRAM), NAND-flash memory chips, computer display screens, and circuitry for improving computer memory performance.

Samsung filed counterclaims alleging patent infringement by AMD and/or ATI of six Samsung patents that generally relate to semiconductor fabrication and design. Both parties are seeking damages and injunctive relief.

During the litigation, the parties reached agreement on five of Samsung's asserted patents and two of AMD/ATI's asserted patents, which have been dismissed. In addition, Samsung filed a motion for partial summary judgment arguing that Samsung did not infringe the asserted claims of one of the AMD patents, U.S. Patent No. 5,559,990, which relates to improving computer memory performance.

Result

The court granted Samsung's motion for partial summary judgment. U.S. District Judge Susan Illston ruled that no reasonable jury would find that Samsung infringed U.S. Patent No. 5,559,990.
