Facts

The plaintiffs were traveling in a van en route to Reno, Nev. They were driving along a straight, narrow, two-lane California Highway (State Route 70). The plaintiff Dufford was driving the van and Baugus was sitting in the front passenger seat. A vehicle driven by Vallette, who was intoxicated at the time, was traveling in the opposite direction. Vallette's vehicle crossed the center line and collided into the van driven by Dufford. Vallette was killed in the accident and Dufford survived with minor injuries. As a result of the collision, Baugus suffered a broken neck and was a quadriplegic for three weeks, after which he slowly regained use of his extremities.

Settlement Discussions

The plaintiff initially demanded $6 million, negotiated later to $1.7 million before trial.

Injuries

The plaintiff Baugus claimed to be left with a fused cervical spine and weakness throughout his extremities and constant excruciating pain, rendering him unable to continue his employment as a truck mechanic and dependent on significant amounts of pain medication.
