The plaintiff, a 92-year-old woman, was a patient at defendant hospital after she sustained an orthopedic injury at an assisted living facility. Over the course of a two-week period, she developed a stage 3 decubitus ulcer on her coccyx. The ulcer was not detected until after the defendants released the plaintiff back into the care of the assisted living facility. The plaintiff was then
immediately sent to a skilled nursing facility that specializes in wound care. She remained at the skilled nursing facility for almost two months. The plaintiff filed suit based on theories of negligence, neglect under welfare and institutions code section 15600 et seq., and negligence per se.
Damages
The plaintiff alleged special damages of $26,400.
Other Information
The plaintiff died shortly after the filing of the complaint, from ailments unrelated to either the orthopedic injury or the decubitus ulcer. The complaint for damages was filed but never served on the defendant.
