Facts

On Feb. 15, 2002, the claimant was being trained by his employer to learn to operate a bus. During training, a co-worker turned the wheel on the bus while on the freeway, causing it to crash. The claimant initially sued his employer but eventually dismissed after law and motion due to Labor Code preclusion and resolution of worker's compensation claim. OCTA remained as the sole defendant.

Several discussions took place regarding evidence of independent negligence of the respondent, the claim of the failure to appropriately file claim with the respondent and damages, the parties settled.
