Facts

The plaintiff was a patron in the defendant's establishment on Sep. 21, 2001 at approximately 12:30 a.m. He had dinner and drinks with a friend. After dinner, while walking to the patio, he was struck by an unidentified assailant. The force of the blow caused the plaintiff and the assailant to both go to the ground. The bartender picked the plaintiff up off the ground while another defendant's employee escorted the assailant from the premises.

Settlement Discussions

The plaintiff initially demanded $150,000, subsequently reduced to $50,000 and then $30,000 during trial. No offers were disclosed.

Injuries

The plaintiff suffered a right malar tripod fracture and a right zygomatic arch fracture. The injury resulted in a facial reconstructive surgery on Oct. 2, 2001, which included the placement of three titanium plates and 12 titanium screws in the plaintiff's face in order to hold the eye socket together. The plaintiff has residual ringing in the ears and some blurred vision in the right eye. The plaintiff also has a drainage from the ear and frequent tearing of the eye. The plaintiff missed two weeks of work after the surgery. The plaintiff worked as a quality control engineer.
