Facts

Plaintiff, a 42-year-old salesman, claimed he had an oral contract with Defendant company to market their record/playback teddy bears. Defendant disputed the existence of a contract. Plaintiff went elsewhere when Defendant declined to retain his services. Defendant then sent 2 letters on June 28, 1993, and July 15, 1993, to Plaintiff's employer and the president of the company with whom his employer was doing business. The letters alleged that Plaintiff absconded with some of Defendant's teddy bear prototypes and that he had a dubious reputation.

Settlement Discussions

Plaintiff contends his highest demand was $1,500,000 and Defendant's lowest offer was $25,000.
