Facts
On October 2, 1991, Plaintiff, a 27-year-old fire sprinkler installer, was installing an overhead fire sprinkler system in a building being constructed for a large supermarket chain. While driving an elevated scissors lift from one position to the next, the front wheel of the heavy equipment dropped into an opening in the floor that was not covered. The opening, approximately 24 inches in diameter, was intended to ultimately accept a floor sink or drain. The scissors lift tipped over and threw Plaintiff to the ground.
