On October 21, 1992, Plaintiff Michael Magie, a 28-year-old paramedic in the course and scope of his employment and a passenger in an ambulance, was proceeding on Pearl Avenue in the City of Redlands on a Code 3. At the same time, a fire engine for Defendant City of Redlands was proceeding on Orange, also on Code 3. The 2 emergency vehicles were responding to a separate emergency calls. The intersectional traffic signal was red for Defendant's fire engine. The intersection was basically a "blind" intersection, due to freeway walls and ramps. The front end of the ambulance struck the side of the fire engine at dead center, as it entered the intersection.

Defendant contends it offered $35,000 prior to trial and Plaintiff and his estranged spouse demanded $100,000 reduced to $60,000.
