Facts
On February 4, 1993, Plaintiff Karapet Guledjian, a 50-year-old unemployed man, presented to Defendant Dental Plus Dental Group for a post and crown procedure. Plaintiff aspirated the post while it was being tried in by a registered dental assistant. Surgery was necessary to remove the post, a dental filling. When Defendant Dental Plus Dental Group (and the dental assistant) claimed that Defendant Windom supervised the dental assistant, Defendant Windom said that he did not supervise the dental assistant and did not tell her to try in the post.
Settlement Discussions
Plaintiff contends his demand was $185,000 prior to trial and the offers were $100,000 from Dental Plus and zero from Defendant Windom. Defendant contends their offer was $100,000 from Dental Plus alone or $150,000 from both Defendants with Defendants to arbitrate their respective contributions; and Plaintiff demanded $200,000 prior to trial, reduced to $185 during trial.
