Facts

During the Civil Disturbance of April 1992, Plaintiff's 10,000-square-foot commercial building was damaged by fire; however, the unreinforced masonry walls of the building remained standing. In May of 1992, Defendant city issued an order to demolish the Plaintiff's building. Plaintiff filed an appeal to the building and safety commission. Defendants denied Plaintiff's appeal on September 8, 1992; the building was demolished on September 28, 1992.

Plaintiff contends that the offers and demands exchanged prior to this result were too numerous to mention here.

Damages

Plaintiff claimed $300,000 difference between the cost to repair the building and the cost to replace the same. Plaintiff also claimed unspecified loss of rental income.
