Facts

On Thursday, February 11, 1993 a 46-year-old homemaker presented to Defendant medical group; she complained of watery and scratchy eyes while reading; that was her only complaint at the time. On Sunday, February 14, she became dizzy and weak while at church. She was immediately seen at a local medical clinic; she received a prescription and was told to see her family doctor (Defendant medical group) the next day. On Monday, February 15, this patient was seen at Defendant medical group by a licensed physician's assistant for evaluation and treatment. She described symptoms of dizziness and weakness for the previous 3 days as well as pain in her left lower leg. After an examination, it was found that her left calf muscle was swollen and tender; although no indication was made of any treatment or diagnostic plan related the left calf pain; it was concluded by the physician's assistant that the patient was anemic due to undetermined blood loss; and blood was taken for testing. On Wednesday, February 17, she was examined by another physician; this physician ordered immediate hospitalization; a blood transfusion to treat anemia; and immediate Doppler ultrasound flow study of the patient's left lower leg to determine whether she was suffering from deep vein thrombosis (DVT). Within a few hours, she died from massive pulmonary emboli in the pulmonary artery. Plaintiffs were the decedent's husband and daughters.
