On June 29, 1993, Plaintiff, a 42-year-old female hospital worker underwent a total abdominal hysterectomy at Defendant hospital, for benign tumors on her uterus. She was discharged on the morning of July 3, 1993, although suffering from an extreme tachycardia and fever. She returned less than 24 hours later on the afternoon of July 4, 1993 with complaints of fever, nausea and a rapid heart rate. She was taken to surgery that evening and peritonitis was found in her abdomen which resulted from a puncture made in her sigmoid colon on June 29. During the distress, her heart stopped, requiring cardiac resuscitation. However, because of the cardiac arrest, her brain went without oxygen for a significant period of time, causing brain damage.
