Facts

Defendant Dr. Youngerman, a general practitioner, began treating Plaintiff Jennifer Kallini shortly after her birth in August of 1991. She was born with a growth on her upper left scapula which extended under her armpit. Dr. Youngerman performed ultrasound examinations, revealing that the growth was probably a benign, fluid-filled cyst. By the end of 1991, the cyst had enlarged considerably. Dr. Youngerman aspirated its contents on January 3, 1992. Within days after aspiration, the cyst enlarged, the cyst wall became inflamed, and the child became ill and anemic. The child was admitted to County Hospital on January 8, 1992, where she received a blood transfusion and had the cyst removed 6 days later; this was after the infection had been controlled with IV antibiotics. It turned out to be a benign cystic hygroma.
