Facts
Defendant Casitas Municipal Water District operates the Lake Casitas Recreational Area. On February 4, 1994, an individual named Joseph Buc entered the Lake Casitas Recreational Area (LCRA), drove to his assigned campsite, and then decided that he was going to return to the main gate to change his campsite. On the way back to the main gate, he collided with Plaintiff Randy J. Crabtree, a 35-year-old brake mechanic, in a head-on collision. Joseph Buc died in the accident, and Plaintiff sustained multiple fractures to his right foot. The accident occurred 15 minutes after Joseph Buc had been admitted into the LCRA; blood alcohol tests later performed on Joseph Buc indicated .43 blood alcohol.
