Facts
This was a wage and hour class action. The claims were for unpaid overtime wages, as well as meal and rest break violations. The class was a group of investigators located throughout the nation.
Contentions
PLAINTIFFS' CONTENTIONS:
The plaintiffs contended that MJM violated both federal and state wage laws by failing to pay for all the time that the investigators worked. A hybrid class and collective action was filed in federal court.
DEFENDANT'S CONTENTIONS:
MJM contended the class members did not work the overtime hours, and, if they did, it was without the knowledge of MJM. The class could not be certified due to individual variations.
Result
The $2.5 million settlement, with an attorney fee award of $833,333 (plus 10 percent interest), was given final approval by Judge James Selna.
