The plaintiff was using the defendantÆs slow pitch batting cage facility when he slipped and fell after 15
to 20 seconds of light drizzle. It had not rained previously that day. There were no prior incidents in more than
25 years of operation.

Injuries

Fracture to left ankle with surgery, including screw and bolt placement to stabilize, and requiring subsequent surgery to remove the hardware. According to the defendant, plaintiff and defendant stipulated to medical specials of $32,500, which included future surgery to remove the hardware.
