Facts

In 1994, plaintiff, then 58 years old, sought orthodontic treatment from defendant. Defendant
placed orthodontic appliances and told her the process would take approximately 26-30 months.
Prior to placing the appliances, defendant took X-rays which revealed problem periodontal areas.
From 1994 until July 1998, the defendant did not take any X-rays of plaintiffÆs mouth. The July
1998 films revealed significant bone and gum loss.

Settlement Discussions

The plaintiff demanded $100,000 pursuant to C.C.P.Section 998.
