Facts

Uhrich, the plaintiff, sued her ex-psychologist, Lindseth, for defamation, infliction of emotional distress and other
related causes of action due to LindsethÆ statements. LindsethÆs insurer, defendant American Home Assurance
Co., denied Lindseth defense and indemnity in that case. In an uncontested trial, plaintiff obtained a judgment
against Lindseth.
Plaintiff then sued defendant American Home Assurance Co. The trial judge adjudicated that American Home
Assurance Co. had a duty to defend Lindseth in the underlying action and indemnify him for the stipulated
judgment.

Damages

Defendant Lindseth's defamatory statements regarding plaintiff and his other acts which inflicted emotional distress resulted in severe psychological injury and economic loss.

Other Information

Plaintiff is proceeding to a jury trial on the issues of emotional distress, attorney fees and punitive damages. American has filed petitions for writs of mandate and prohibition before the Third Appellate District.
