Facts

Cecelia Carter filed a whistleblower action against Fannie Mae and the Federal National Mortgage Association, in connection with her allegedly wrongful termination.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff was a foreclosure specialist for Fannie Mae. She allegedly began reporting a kickback scheme perpetrated by managers in 2009. Following her termination in 2011, plaintiff filed suit, alleging she was fired in retaliation for her reporting the kickback scandal. Plaintiff claimed she was targeted for being black. Plaintiff contended that defendants' conduct constituted race discrimination and retaliation, as well as whistleblower retaliation in violation of public policy and wrongful termination.

DEFENDANTS' CONTENTIONS:
Defendants denied discriminating and retaliating against plaintiff. Rather, defendants claimed plaintiff was fired for recording a conversation without first obtaining consent of all parties involved, violating California law.

Defendant also denied that any kickback scheme existed. Fannie Mae denied all allegations.

Injuries

Carter claimed she suffered from emotional distress resulting from her termination.

Result

The jury found in favor of Fannie Mae on all counts and the jury also found in favor of Fannie Mae on its affirmative defense of failure to mitigate damages.
