Facts
On January 25, 1993, Plaintiff, a 40-year-old truck driver, was driving his tractor (of a tractor/trailer rig) only on the 605 Freeway. Defendant was driving his tractor/trailer rig on the 605 Freeway at approximately 55 to 60 mph. Defendant swerved left to avoid striking stopped traffic; the trailer jackknifed, sending Defendant across several lanes and into Plaintiff. Plaintiff then spun several times, hit the center divider, and came to a rest. Following the collision, Defendant's driver tested positive for cocaine, amphetamines, and barbiturates.

Plaintiff contends he demanded $300,000 and Defendants offered $47,500.
