On December 7, 1992, two Plaintiffs, driver Joseph Baeza and passenger Lindy Robinson, both aerospace workers and ages 45 and 40 years respectively, were traveling on the southbound 405 Freeway. They changed lanes to avoid a collision with an out-of-control Pontiac driven by Defendant Daniel Carroll (owned by Susanne Carroll). Defendant C.F. Trucking's tractor/trailer rig driven by Freddie Salmeron, then struck Plaintiffs' automobile in a rear end collision. Daniel (and Susanne) Carroll settled before trial.

Settlement Discussions

Defendant F.A. Salerman contends it offered $5,000 to Baeza and $7,500 to Robinson; Robinson demanded $40,000 and Baeza demanded $20,000.

Prior to this verdict, Defendant Daniel Carroll settled out for a total of $45,000 ($20,000 to Baeza; $25,000 to Robinson).
