Facts
On August 6, 1993, Shawn Fulgham, a 16-year-old student, was operating a 750 Kawasaki jet ski when he was struck and killed by another watercraft operated by Defendant Richard Heine. The accident occurred in a narrow reed-lined channel just off of the Colorado River near the city of Lake Havasu, Arizona. Plaintiffs were decedent's parents, Jim and Carol Fulgham, who initiated an investigation and subsequent litigation into their son's death when they were informed by the Mohave Sheriff's Department that their son was cited as being at fault for the accident despite contradictory statements by eyewitnesses.
