The Alfred E. Mann Foundation for Scientific Research, or AMF, is a nonprofit medical research foundation. Cochlear Corp. is a for profit corporation that is in the business of manufacturing and selling cochlear implants.
AMF sued Cochlear for infringing on its patents.
Contentions
PLAINTIFF'S CONTENTIONS:
AMF argued that the fitting and testing processes used by Cochlear for its implants infringed on AMF's patents. Based on this, AMF asserted causes of action for patent infringement.
DEFENDANT'S CONTENTIONS:
Cochlear denied AMF's allegations, and asserted various affirmative defenses. Among those defenses, Cochlear claimed it had not infringed AMF's patents, and argued that the patents were invalid.
Result
A jury found that Cochlear had willfully infringed on AMF's patent, and awarded $131,216,325.
