Facts

Plaintiffs, on behalf of themselves and a putative class, filed a class action lawsuit against their employer, principally based on unpaid minimum and overtime wages, but also requesting various statutory penalties.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiffs contended that they were misclassified as a class as exempt from overtime pay. The putative class alleged they were essentially maintenance workers who, at all times, worked overtime hours yet were never provided any overtime compensation.

DEFENDANT'S CONTENTIONS:
Defendant contended that the putative class were properly classified as exempt from overtime compensation and, at all times, were properly paid for the work they performed.

Result

The putative class and defendant settled the matter for $4.5 million. On Oct. 25, 2013, the court confirmed the class action settlement. All settlements funds were finally disbursed as of Jan. 9, 2014.
